Terms of Service;

✧ General ✧

By commissioning me, you're acknowledging and accepting my TOS, which includes the following (if you have any question please let me know) :

• At the first stage, please provide a brief or requirements for how you envision your commission, so we can ensure a shared understanding and vision.

• I (as an Artist) reserve the right to decline any commission that I feel uncomfortable with after reviewing the brief or requirements. you will receive a full refund for your commission fees if you get canceled. Please note that if you have paid for a waitlist slot, the waitlist fee is non-refundable.

• I (as an Artist) don't accept rush orders for any type of commission or use.

✧ Payment ✧

• Before I (as the artist) start working on your commission, you (as the client) need to pay the full amount if the commission fee is under $50. For commissions over $50, 50% upfront payment from the total price is needed to secure your commission spot.

• Prior to receiving the completed artwork, clients must fulfill the remaining 50% payment.

• Payment for invoices or payment links is expected within 24-48 hours. Failure to meet this deadline will result in the cancellation of your slot. If you encounter any difficulties in meeting the payment deadline, please inform me as soon as possible.

• If my commission slots are filled, but you'd like to join the waitlist, a 50% waitlist fee based on the total commission price is required. This fee is separate from the total commission price and is non-refundable.

• I accept payment through Stripe (I will send an invoice), Buy me a coffee (I will send the link),
Paypal (not recommend), Thai local bank transfer, SWIFT transfer for international bank transfer.

✧ Revision ✧

• You can request up to three revisions at no extra cost during the commission process, from the sketch to the finished work, for all types of commissions.

• If you've used up your three revisions, any further changes will require an additional fee, which will vary based on the type and complexity of your commission.

• You cannot revise anything on skeb-like/surprise me commission type. If you would like to revise the work from this kind of commission, you may need to pay with the full 100% of commission price in advance.

• If you (as the Client) need to make further changes or revisions that may need an Artist to redraw the entire artwork after confirming the sketch, there may be an additional charge of 50-100%, depending on the commission's progress and complexity. Please note, this is separate from the three free revisions policy. Even if you still have remaining revision quota, significant changes such as the whole new pose or sketch may require this additional fee.

✧ Refund ✧

• Any paid for waitlist slots or/and commissions are non-refundable unless the artist is unable to complete the commission.

✧ Deadline and Delivery ✧

• Each type of commission has a different Turnaround Time (TAT), which will be specified in each commission post.

• Please inform me (the artist) of any deadlines you have in mind from our first discussion.

• I do not accept rush commissions, so please keep this in mind if you have a tight deadline. You can review my queue and working process on my Trello.

• Please note that I will not keep your commission files for more than 7 days after delivery (digital only), so please remember to save your commission once I send it to you.

✧ Use ✧

• You (as the Client) commission artwork for Personal Use, you may use your commission only for non-commercial purposes and not for VTuber-related content.

• You (as the Client) commission artwork for Digital Commercial Use, you may use your commission for any digital commercial purposes, including VTuber-related content, promotional activities on monetized social platforms, and digital products.

• You (as the Client) commission artwork for Commercial Use, you may use your commission for any commercial purposes, including digital and physical products.

• You (as the Client) may not reproduce, edit, copy, or provide my artwork at any stage (from sketch to final work) to another artist for duplication or modification without my permission.

• You (as the Client) may not use my artwork at any stage (from sketch to final work) for training AI (artificial intelligence) or for any other AI-related purposes.

• You (as the Client) may not use my artwork at any stage (from sketch to final work) for any NFT purposes.

✧ Intellectual Property Rights ✧

• Ownership : I (as the Artist) retain all rights and ownership of the commissioned artwork, including all intellectual property rights, unless otherwise agreed upon in writing or required by law.

• License to Client : I (as an Artist) grant you (as the Client) a non-transferable license to use the artwork only for the purposes agreed upon and specified in the commission agreement, with proper credit to the Artist.

• Non-Disclosure Agreement (NDA) : Both parties agree to maintain confidentiality regarding the commission terms, with exceptions only as required by law or mutual agreement.

• If you (as the Client) want to own the Intellectual Property Rights (IPR), please inform me before we begin, as there will be additional fees.

✧ Communication & Contacts ✧

• Communication : For ongoing communication, please continue using the platform where the commission was initiated. In case of emergencies and no response within 24-48 hours, you may contact me using alternative contacts.

• Language & Timezone : I speak Thai (native) and English (casual). You're welcome to contact me in either language. My timezone is GMT+7, so please expect responses within 6-12 hours.
